Customer Membership Terms & Conditions

These Airtasker US Customer Membership Terms & Conditions (US Membership Terms) are between you and Airtasker USA Inc., a company incorporated in the State of Delaware (Airtasker). These Terms govern the purchase, renewal and use of an individual customer Airtasker US membership. By purchasing, renewing, or using an Airtasker US Membership, you agree to these US Membership Terms and any use of the Platform is also subject to Airtasker's Website Terms and Conditions available at www.airtasker.com/us/terms (collectively, the Terms).

1. About the Membership

  • 1.1 An Airtasker US membership is a paid membership program that entitles the individual account holder (Member) to assign tasks on the Airtasker US platform www.airtasker.com/us (Platform) without having to pay an associated Connection Fee (Airtasker US Membership).

  • 1.2 During an active Membership Period, Members receive $0 Connection Fees on all tasks booked through the Airtasker US platform (Membership Benefits), subject to fair use and these US Membership Terms.

2. Membership fees and term

  • 2.1 An Airtasker US Membership costs $59 USD annually, excluding any applicable state and local taxes based on your billing address.

  • 2.2 The full cost of the annual Airtasker US Membership is due at the time of purchase.

  • 2.3 An Airtasker US Membership is valid for 12 months commencing from the date of purchase (Membership Period).

  • 2.4 At the end of the Membership Period, the Airtasker US Membership will automatically renew for a successive 12-month period (being a new Membership Period) unless the Airtasker US Membership is terminated prior to the renewal date, in accordance with these Membership Terms.

  • 2.5 By completing your purchase, you affirmatively acknowledge and consent to automatic renewal and authorise Airtasker to automatically charge your nominated card (or another card held on file) for the annual fee and each renewal at the then-current Airtasker US Membership annual price.

  • 2.6 You are responsible for ensuring your payment details remain accurate and up to date. A failed or declined payment does not relieve you of your obligation to pay.

  • 2.7 From time to time, we may offer different membership programs, and the fees and terms for those different memberships may vary. You will find details about the membership model you are subscribed to, the applicable membership fee and the next due date in your account.

3. Payments

  • 3.1 An Airtasker US Membership can be purchased by any individual with an active Airtasker US user account who is aged 18 years or over.

  • 3.2 To purchase an Airtasker US Membership, you must visit the Airtasker Membership Landing Page and follow the steps to purchase.

  • 3.3 Airtasker US Memberships cannot be purchased using gift cards, Airtasker credits, vouchers, or coupon codes.

  • 3.4 Airtasker US Memberships can only be purchased by the individual account holder who will be the Member. Airtasker US Memberships cannot be purchased for any other individual or account.

  • 3.5 Airtasker US Memberships are for individuals only and are not currently available to businesses.

  • 3.6 Airtasker US Memberships cannot be purchased through the Airtasker mobile application and must be purchased via the Airtasker website.

4. Cancellation by you and refunds

  • 4.1 You may cancel your Airtasker US Membership at any time using any of the following methods:

a) Online self-service: Access the membership purchase confirmation email with subject Your membership is now active! sent on the day that you purchased your membership. Click the Cancel auto-renewal link, provide your email address on the next page, then click Confirm Cancellation. This is the quickest method.

b) Email: Alternatively, send your cancellation request from your account email address to [email protected] and our support team will manage your request.

To avoid being charged for the next Membership Period, your cancellation must be completed at least 7 days before your next renewal date. We will confirm your cancellation by email within one business day.

  • 4.2 Airtasker US Memberships are not refundable. Cancelling your Airtasker US Membership means it will not automatically renew at the end of the current Membership Period. Cancelling does not entitle you to any credit, refund or exchange. Nothing in this clause limits any refund rights you may have under your state's applicable consumer protection laws. If you believe you are entitled to a refund under state law, please contact us at [email protected].

  • 4.3 TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AIRTASKER US MEMBERSHIP FEES ARE NON-REFUNDABLE, INCLUDING WHERE THE MEMBERSHIP IS PARTIALLY USED, COMPLETELY UNUSED, OR WHERE THE MEMBER ACCOUNT HAS BEEN RESTRICTED, DEACTIVATED FOR MISUSE, OR DELETED AT THE MEMBER'S REQUEST. WHERE STATE LAW PROVIDES RIGHTS THAT CANNOT BE WAIVED BY AGREEMENT, THOSE RIGHTS ARE NOT AFFECTED BY THESE TERMS.

5. Fair use

  • 5.1 The Membership Benefit during an active Membership Period entitles Members to receive $0 Connection Fees on all tasks booked through the Airtasker US platform.

  • 5.2 Airtasker US Memberships are for individual use only and are subject to fair use. Airtasker may impose reasonable limits, monitoring, or restrictions to prevent use outside of fair use, which may include, but are not limited to, the following:

i. Excessive, repetitive, or abusive booking behaviour.

ii. Sharing access to or use of an Airtasker Member account between other users or by businesses.

iii. Behaviour that Airtasker determines to be fraudulent, exploitative or otherwise outside of ordinary individual customer use.

iv. Booking patterns inconsistent with individual consumer use (for example, commercial volumes).

If Airtasker determines fair use has been abused, it may warn you and require cessation, temporarily restrict your Membership Benefits, or suspend or terminate your membership and account without refund.

6. Account use and non-transferability

  • 6.1 Airtasker US Memberships are non-transferable and may only be used by the individual Airtasker account holder.

  • 6.2 You must not share your account credentials or allow any third party to access or use your Airtasker US Membership.

  • 6.3 Any attempt to transfer, share, or misuse an Airtasker US Membership may result in immediate restriction, suspension, or termination of the account without any refund.

7. Suspension and termination

  • 7.1 If Airtasker determines at its sole discretion that you have breached these US Membership Terms or Airtasker's Website Terms & Conditions, Airtasker may immediately restrict, suspend, or terminate your Airtasker US Membership or Airtasker account.

  • 7.2 In the event that your Airtasker account is restricted, suspended, or terminated for breaching Airtasker's Website Terms and Conditions or Community Guidelines, you will not be entitled to any refund, credit, or compensation.

  • 7.3 Airtasker reserves the right to accept or refuse any attempts to purchase or use an Airtasker US Membership, to the extent permitted by applicable law.

8. Changes to the membership

  • 8.1 Airtasker may, in its reasonable discretion, change these US Membership Terms, the Membership Benefits, discontinue the Membership program or modify its pricing. Any changes will not affect your right to cancel your Membership auto-renewal at any time. Where we make material changes to these US Membership Terms or the Membership Benefits, we will provide you with at least 30 days prior written notice via email to the address associated with your account or through your account dashboard. If you do not agree to the change, you may cancel your membership before it takes effect (see Section 4 for cancellation instructions).

  • 8.2 If any change to these US Membership Terms is found invalid, void, or for any reason unenforceable, that change is severable and does not affect the validity and enforceability of any remaining changes or conditions.

  • 8.3 Continued use of a Membership after changes take effect constitutes acceptance of the updated US Membership Terms.

9. Disclaimers and liability

  • 9.1 Holding an Airtasker US Membership does not guarantee Tasker availability, pricing, or service outcomes. It merely provides the member with the Membership Benefits.

  • 9.2 Pursuant to Airtasker's Terms and Conditions, you specifically acknowledge and agree that any services provided to you in relation to a Task you post on the Platform will be the services of an independent contractor engaged by you. To the extent permitted by law, Airtasker is not liable for any loss arising out of or in any way connected with the services provided to you by an independent contractor in relation to any Task.

  • 9.3 TO THE MAXIMUM EXTENT PERMITTED BY LAW, AIRTASKER EXCLUDES ALL LIABILITY ARISING FROM OR IN CONNECTION WITH AIRTASKER US MEMBERSHIP USE. IN NO EVENT SHALL AIRTASKER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE MEMBERSHIP, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF AIRTASKER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

  • 9.4 NOTHING IN THESE TERMS LIMITS ANY STATUTORY CONSUMER PROTECTION RIGHTS UNDER APPLICABLE FEDERAL OR STATE LAW THAT CANNOT BE EXCLUDED OR WAIVED BY AGREEMENT.

10. Privacy

  • 10.1 Personal information collected in connection with your Airtasker US Membership is handled in accordance with Airtasker's Privacy Policy.

10A. Dispute resolution

10A.1 Informal resolution: Before raising a formal claim, please contact us at [email protected] and give us 30 days to try to resolve the issue informally.

10A.2 Binding arbitration: If we cannot resolve it informally, any dispute arising out of or relating to these US Membership Terms will be settled by binding individual arbitration under JAMS rules, conducted in the state where you reside.

10A.3 Small claims exception: Either party may bring a qualifying claim in small claims court instead of arbitration.

10A.4 CLASS ACTION WAIVER: YOU AGREE TO RESOLVE DISPUTES WITH AIRTASKER INDIVIDUALLY. YOU WAIVE ANY RIGHT TO PARTICIPATE IN, OR BRING, A CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING AGAINST AIRTASKER. A COURT MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS WITHOUT THE CONSENT OF ALL PARTIES.

10A.5 State law rights preserved: Nothing in this section waives any non-waivable rights you have under your state's consumer protection laws.

11. General

  • 11.1 Airtasker US Memberships cannot be used in conjunction with other offers unless expressly stated.

  • 11.2 TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, AIRTASKER MEMBERSHIPS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. AIRTASKER EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. SOME STATES DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU. YOU MAY ALSO HAVE OTHER RIGHTS THAT VARY FROM STATE TO STATE.

  • 11.3 In the event of any inconsistency between Airtasker's Terms & Conditions and these US Membership Terms, these US Membership Terms will prevail in relation to the Airtasker US Membership.

12. Governing law

  • 12.1 These US Membership Terms are governed by the laws of the State of California, United States of America, without regard to its conflict of law principles.

  • 12.2 Subject to the arbitration clause in Section 10A, you agree to submit to the jurisdiction of the state and federal courts located in California, provided that nothing in this clause prevents you from pursuing claims in your home state under local consumer protection laws that cannot be waived.
